Father files restraining order against 5-year old bully [VIDEO]

An injunction hearing is proceeding today against a five-year old Wisconsin boy accused of bullying a six-year old girl.

Brian Metzger presented a temporary restraining order to Prairie Lane Elementary School on May 13 after his daughter was threatened and physically assaulted by a classmate. Metzger is fighting to have the boy expelled.

The father says the child has been a problem for his daughter and other students all year.

In one incident, the boy allegedly threatened to physically harm his daughter.

"She came home and said a student threatened her by saying, 'I want to slit your throat and watch you bleed,'" Metzger told WISN Milwaukee.

Metzger stated that he complained to school officials, but they failed to remove the problematic child from the classroom.

The behavior progressed, and on May 12, the boy kicked his daughter in the face and threw sand and rocks at her. The bully was sent home for "disorderly conduct," according to a Pleasant Prairie Police Department report.

Metzger filed a restraining order on behalf of his daughter against the child the next day.

The elementary school removed the boy from the classroom on May 14, but he still attends the same school as Metzger's daughter. The father says that as long as the boy is in the Kenosha Unified School District, he is a threat to other students.

"I want him removed from the school district, period," Metzger told CBS 58.

The offending child has not been identified, and his family has not released a statement.

In regards to the case, District spokesperson Tanya Ruder said, "There's always two sides to every story." She continued, "There's not a set threshold of what causes or what would determine when a child is moved out of a classroom."

Metzger said that the school has fallen short of its responsibilities. "What they're doing, their policies aren't good enough," he told WISN. "I think they should have done something a lot sooner."
