An emergency custody hearing for Usher and his ex-wife Tameka Foster's two children will take place today at 2 p.m. The coverage of the hearing will be available on HLN and can be seen via the live stream link here.

The emergency court hearing will take place after Tameka Foster filed for an emergency custody hearing on Tuesday, Aug.6, following the incident involving her five-year-old son being rushed to the intensive care unit on Monday after a pool-related accident. The court filing says the 5-year-old suffered "a near-death accident" while left unsupervised at the R&B singer's home.

Tameka Foster was not happy with her son's latest pool incident which happened while in the care of her ex-husband Usher.

The 42-year-old celebrity stylist filed legal documents in Fulton County, Ga., and has demanded custody of her two sons, Usher Raymond V, 5, and Naviyd Ely Raymond, 4.

Usher, 34, was granted primary custody of the two boys last year following years of a bitter custody battle.

However, after the accident on Aug. 5, Foster is claiming that Usher has allowed other unfit people to care for their children, therefore, creating an unsafe environment, according to Us Weekly.

According to TMZ, the boy's arm had gotten caught in the drain of a pool at his father's home while he was playing with his aunt. The boy dove underwater to retrieve a pool toy but had his arm caught in the process. His aunt, Usher's sister, immediately swam down to help the boy but was not able to do anything. A maid also came to try and help but she screamed for help when she couldn't do anything. Two men that had been working in the house rushed to the scene, dove into the pool and was able to free the boy from the drain.

The boy was given CPR and taken to hospital. Usher, who was not at home at the time of the incident, rushed to home immediately and was in the ambulance with his son when he was taken to hospital.

Foster provided an update on her son's condition via Twitter. "Im very happy this morning, my son is resting well...we had a SpongeBob marathon ALLL night, he wouldn't go to sleep! Thank u 4 the prayers."

On Wednesday, Usher also posted a note on his website: "I would like to thank my Aunt Rena as well as the doctors and nurses who are working with us around the clock. I would especially like to thank the two men who saved my son's life, Eugene Stachurski and Ben Crews. They are true heroes and I am deeply grateful to them."
